1. Overview
These Website Terms of Service (“Terms”) govern your access to and use of the website located at https://www.themastermind.com.au (the “Site”), operated by The Mastermind (“The Mastermind,” “we,” “us,” or “our”).
By accessing or using the Site, you agree to these Terms. If you do not agree, do not access or use the Site.
These Terms apply to website use only. Enrolment in our coaching programs, events, or other services is governed by a separate written agreement between you and The Mastermind. If anything in these Terms conflicts with that agreement with respect to program or event participation, that agreement governs.
2. Eligibility
You must be at least 18 years of age to access or use the Site.
3. Privacy
Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
4. Intellectual Property
The Site and all content on it — including text, graphics, images, photographs, videos, logos, trademarks, trade names, service marks, methodologies, frameworks (including references to the Client Engine System™), and other content (collectively, “Site Content”) — is owned by or licensed to The Mastermind and is protected by Australian, United States, and international intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and view the Site Content for your personal, non-commercial informational use only. You may not:
- Copy, reproduce, distribute, publish, publicly display, or create derivative works from the Site Content, except where expressly permitted
- Modify the Site Content or remove any proprietary rights notices
- Use any automated means — including scraping, robots, spiders, or data mining tools — to access, collect, or extract data from the Site
- Use the Site or Site Content to train any artificial intelligence or machine learning model
- Frame, mirror, or otherwise incorporate the Site or Site Content into another website or service without our prior written consent
All rights not expressly granted are reserved.
5. Prohibited Conduct
When accessing or using the Site, you will not:
- Violate any applicable law or regulation
- Interfere with, disrupt, or attempt to gain unauthorised access to the Site, its servers, or any related systems
- Transmit any virus, malware, or other harmful code through the Site
- Attempt to reverse engineer, decompile, or disassemble any part of the Site
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
- Use the Site in any manner that could damage, disable, overburden, or impair its functioning
6. User Submissions
If you submit any information to us through the Site — for example, through a contact form, application, enquiry, newsletter subscription, or testimonial — you represent that the information is accurate and that you have the right to provide it.
You grant us a non-exclusive, royalty-free, worldwide, sub-licensable licence to use any content you submit through the Site for the purposes of responding to you, operating the Site, and marketing our services. You may withdraw any testimonial you have provided by contacting us in writing; withdrawal applies on a going-forward basis.
7. Third-Party Links
The Site may contain links to websites, services, or content operated by third parties. We do not control, endorse, or take responsibility for any third-party websites, services, or content. Your use of any third-party site or service is at your own risk and subject to that third party’s terms and privacy policy.
8. Information on the Site
The information on the Site — including blog posts, case studies, testimonials, frameworks, and general educational content — is provided for general informational and educational purposes only. It does not constitute legal, accounting, tax, financial, investment, or professional advice, and should not be relied on as such. You should seek advice from qualified professionals before making business, financial, or legal decisions.
Testimonials and case studies reflect the experience of the individuals or businesses referenced and are not a guarantee, promise, or representation of results you will achieve.
9. Disclaimers
To the maximum extent permitted by law, the Site and all Site Content are provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or completeness.
We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
Nothing in these Terms excludes any statutory guarantee, warranty, or right that cannot lawfully be excluded.
10. Limitation of Liability
To the maximum extent permitted by law, The Mastermind and its affiliates, officers, directors, employees, contractors, and agents will not be liable to you for any indirect, consequential, incidental, special, exemplary, or punitive damages, or for any loss of profits, revenue, business, or data, arising out of or in connection with your access to or use of the Site.
Our total aggregate liability arising out of or relating to your access to or use of the Site is limited to AUD $100.
11. Indemnity
You agree to indemnify and hold harmless The Mastermind and its affiliates, officers, directors, employees, contractors, and agents from any claim, demand, loss, damage, or expense (including reasonable legal fees) arising from your access to or use of the Site, your breach of these Terms, or your violation of any law or third-party right.
12. Governing Law and Jurisdiction
These Terms and your access to and use of the Site are governed by the laws of the State of Queensland, Australia, and the Commonwealth of Australia, without regard to conflict-of-law principles. Any dispute arising in connection with the Site or these Terms will be resolved exclusively in the courts of Queensland, Australia, and you submit to the exclusive jurisdiction of those courts.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will post the amended Terms on the Site and update the “Last Updated” date. Your continued use of the Site after we post changes constitutes your acceptance of the updated Terms.
14. Termination
We may suspend or terminate your access to the Site at any time, without notice, at our sole discretion.
